Daily Bite Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Daily Bite mobile application ("Daily Bite," "the app," "we," "us," or "our"), operated by Successfitness, a sole proprietorship based in Saskatchewan, Canada. By creating an account or otherwise using Daily Bite, you agree to these Terms. If you do not agree, do not use the app. If you are using Daily Bite on behalf of a minor, you confirm you are their parent or legal guardian and accept these Terms on their behalf.

2. The Service

Daily Bite lets you browse a curated recipe library, save and organize recipes into cookbooks, import a recipe by pasting a link, plan meals, and generate grocery lists. Some features may be added, changed, or removed over time, and some features may be limited to paid subscribers.

3. Subscriptions, Billing, and Auto-Renewal

Daily Bite may offer optional paid subscriptions that unlock additional features. Where offered:

• Subscriptions are billed through your Apple ID account and processed by Apple, not by us. Pricing, currency, and available terms are shown in the app before you purchase.
• Subscriptions automatically renew for the same term unless you turn off auto-renewal at least 24 hours before the end of the current period. Your Apple account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription any time in your device Settings under your Apple ID, then Subscriptions. Deleting the app does not cancel your subscription.
• Refunds are handled by Apple under its own refund policies. We do not process payments or issue refunds directly.
• Any free trial or introductory offer, where available, is described in the app at the time it is offered and converts to a paid subscription unless canceled before it ends.

4. Your Account

You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You are responsible for activity that happens under your account. You can delete your account at any time from Profile / Settings inside the app.

5. User Content and Imported Recipes

"User Content" means anything you add to Daily Bite, including onboarding answers, pantry items, cookbook names, and links you paste for recipe import. When you paste a link, Daily Bite fetches the public content of that page and uses an AI service to extract a recipe (title, ingredients, steps, and related details) that is then saved to your account. You are responsible for the links you submit and confirm you have the right to save that content for your personal use.

Daily Bite's curated recipe library is licensed or created for use within the app. You may use it for personal, non-commercial cooking purposes. You may not scrape, republish, or redistribute the curated library or imported recipe data in bulk.

We do not verify the accuracy, safety, or nutritional claims of any recipe, whether curated or imported, and are not responsible for the content of third-party pages you choose to import from.

6. Acceptable Use

You agree not to:

• Use Daily Bite for any unlawful purpose or in violation of these Terms;
• Attempt to interfere with, disrupt, or gain unauthorized access to the app, its backend services, or other users' accounts;
• Use automated means to scrape or bulk-extract data from the app;
• Submit links or content that are unlawful, infringing, or that you do not have the right to share for processing;
• Reverse engineer or attempt to extract the source code of the app, except where applicable law permits it.

7. Health, Allergy, and Nutrition Disclaimer

Daily Bite is not a medical, nutrition, or allergy-safety service. Allergy and dietary preference fields are self-reported and used only to filter and personalize suggestions. We do not guarantee that any recipe is free of a given allergen or suitable for any health condition. Always check ingredient labels and consult a qualified professional for medical or dietary decisions.

8. Intellectual Property

The Daily Bite name, logo, app design, and curated recipe library are owned by Successfitness or its licensors. These Terms do not grant you any rights to our trademarks, branding, or curated content beyond personal use of the app as intended.

9. Disclaimers

Daily Bite is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that recipe imports will always succeed, since import depends on third-party page content and AI processing that we do not control.

10. Limitation of Liability

To the fullest extent permitted by law, Successfitness will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of or inability to use Daily Bite, even if advised of the possibility of such damages. Our total liability for any claim relating to the app is limited to the amount you paid us, if any, in the twelve months before the claim arose.

11. Termination

You may stop using Daily Bite and delete your account at any time. We may suspend or terminate access to the app for anyone who violates these Terms or misuses the service.

12. Changes to These Terms

We may update these Terms as the app evolves or the law changes. We will post the updated version with a new effective date, and for significant changes we will provide notice in the app. Continued use after an update means you accept the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Province of Saskatchewan and the applicable laws of Canada, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of Daily Bite will be subject to the exclusive jurisdiction of the courts of Saskatchewan, Canada.
